KATHMANDU: Vice-president Parmananda Jha on Saturday said President will dismiss Prime Minister Dr Baburam Bhattarai unless he forges consensus among the political parties to conduct the election.

Talking to The RD Show for the Himalayan TV tonight, Vice-president Jha said President will not remain a silent spectator from now onwards; he will relieve PM Bhattarai of power if he fails to conduct election by forging consensus among the political parties.

Vice-president Jha stated either reinstatement of the parliament or the election is the only way out to the present political and constitutional crisis.

At a time when there is only President and the Minister of Council, both the institutions have to move ahead with consensus to bail the country out of the present crisis, he suggested, warning, otherwise, the country will plunge into conflicts.

He further suggested that President should think twice before taking steps as he is only the guardian of the Constitution while the country is devoid of constitution at present.

The government’s bid to bring the full budget sans consensus among the political parties will be unacceptable, he said, urging it to bring only one-thirds of the full budget.

Talking to the programme, Surya Dhungel, legal advisor to the President, revealed that the President will soon call for a national consensus government in line with the constitution

VP Jha is trying to prepare the stage for President Yadav to make a proclamation whereby he is able to dismiss the current PM. This would be a dangerous move and is a power that is not given to the president in the interim constitution. It would be up to the apex court to make a decision to make this legal. Indeed, the interim constitution says: "(2) If consensus cannot be reached pursuant to clause (1), the Prime Minister shall be elected by a majority of two-thirds of the members of the Legislature–Parliament" This means without the CA there is no method for a new PM to be chosen. Further, it has been conscrued by legal scholars that: "In the ultimate sense, the Prime Minister has the right to have his way no matter what the President thinks about it." So Jha and Yadav do not have the power to remove Bhattrai. The obstructing political parties of the NC and CPN-UML will not be victorious in their scurrilous struggle to achieve power through this method.
