Complaint filed against SC justices

KATHMANDU: A complaint was filed recently at Judicial Council (JC) seeking action against justices of the Supreme Court Shushila Karki and Tarkaraj Bhatta accusing them of improperly convicting and sending to jail former minister for information and communications JP Gupta in a corruption case.
Stating that the justices had jailed him with ulterior motive by going against their previous judgments in similar cases, Rajib Kumar Jha of Tilathi-2, Saptari District, filed the complaint.
The Chief Justice headed JC registered the complaint yesterday. Justices Karki and Bhatta issued the verdict slapping Gupta with one-and-half-year jail sentence and a fine of Rs 8.4 million.
Jha claimed that Justice Karki had been guided with a preconceived notions, which was reflected in her article published on June 25, 2007. Jha alleged that the judges had convicted Gupta going against the CIAA vs Laxmi Raj Pathak and CIAA vs Dilli Raman Niroula precedents in which the apex court stated that the agricultural income and the house rent would be taken as the sole income of the accused, but in Gupta’s case, the verdict was against precedent.
