KATHMANDU: Legal experts today amented the intervention of Parliamentary Public Accounts Committee (PAC) into Machine readable passport (MRP) issue.
Stating that the issue is sub judice in court, the parliamentary committee’s directive to the Ministry of Foreign Affairs to go for a bidding process on Friday, the legal experts said it was serious disobedience to the apex court.
“This is a serious disrespect to the Supreme Court,” Prem Bahadur Khadka, President of the Nepal Bar Association told The Himalayan Times. “This is a contemptuous move of the Parliamentary committee when the apex court has already taken up the issue,” Khadka added.
On April 7, the Supreme Court (SC) had issued interim order to the government authorities and directed to implement the decision to provide the printing right to an Indian firm till tomorrow.
A single bench of Justice Sushila Karki also directed Prime Minister Madhav Kumar Nepal, the Office of the Prime Minister and Cabinet, Foreign Minister Sujata Koirala and the printing company, Security Printing and Minting Corporation of India to attend the hearing to be conducted tomorrow.
Advocate Hari Krishna Karki said the PAC order to the Ministry of Foreign Affairs at a time when the case was sub-judice was improper. “This decision may not be intended to influence the apex court but since when it did not wait has created the question whether its intention was good or not,” Karki added.
Advocate Hem Mani Subedi and a law student Nara Bahadur KC filed the PILs demanding apex court order to annul the government decision and direct them to follow the procedures as required by the Public Procurement Act, 2007.
According to a source, the government has recently consulted Attorney General Prof Bharat Bahadur Karki and the senior government lawyers how to defend the case in the apex court.
Maoist CA member Eak Raj Bhandari, however, claimed that since it was not a litigation between land transaction therefore the parliamentary committee can pass its decision. “The PAC decision is not intended to influence the verdict of the apex court since when it has given the order on the matter pending since a long time,” Bhandari added.
