SC verdict on Silwal case on Sept 12

The Supreme Court will deliver its verdict on a case filed by DIG Nawaraj Silwal on September 12.

DIG Silwal has claimed in his writ petition that he has the highest marks in the performance evaluation report, and therefore, he should be promoted to the post of inspector general of Nepal Police.

The apex court will also deliver its verdict on a case filed by Prakash Aryal on September 12.

Aryal, who was promoted to the post of inspector general after the Supreme Court quashed the government’s decision to promote DIG Jaya Bahadur Chand, has argued in his writ petition that he should also be considered for promotion.

Senior advocates Shambhu Thapa, Badri Bahadur Thapa and Advocate Tika Ram Bhattarai pleaded on behalf of

Silwal.

The government’s representatives have argued before a seven-member full bench of the Supreme Court that DIG Nawaraj Silwal doctored his performance evaluation report to claim promotion to the post of inspector general of Nepal Police.

These cases are being heard in a seven-member full bench that comprises Chief Justice Gopal Parajuli, and justices Om Prakash Mishra, Kedar Prasad Chalise, Sharada Prasad Ghimire, Meera Khadka, Prakash Man Singh Raut and Purushottam Bhandari.

The SC, on March 21, had quashed the government’s decision to appoint Jaya Bahadur Chand as the inspector general of Nepal Police. The government had appointed Prakash Aryal as the IGP on April 10.
