KATHMANDU: The Kathmandu District Court (KDC) has sentenced Bhimsen Pundit and Rohit Paliwal Agrawal to eight years in jail and imposed on each a fine of one lakh rupees for the abduction of Omkar Bhattachan and Binod Kumar Neupane.
A single bench of judge Bhoj Raj Adhikari sentenced accomplices Sanjay Shrestha and Ram Kumar Shrestha to seven years in jail and imposed on each of them a fine of Rs 50,000.
One-and-a-half-years ago, the Judicial Council had punished judges Rana Bahadur Bam and Tej Bahadur Karki for issuing judgments in favour of the abductors, who had sought a ransom of Rs 7.2 million for the release of the abductees.
Bam, in the capacity of the chief judge at the Patan Appellate Court, had released the two by accepting their bail plea in a case related to arms and ammunition. Then KDC judge Karki had granted bail to the accused.
KDC had prosecuted the kidnappers in 2007 for the abduction of Bhattachan and Neupane. Chief Justice Ram Prasad Shrestha had recommended to the Parliament to initiate impeachment motion against Bam and sacked Karki.
The Parliament is yet to decide on impeachment against Bam despite efforts from Chief Justice Khil Raj Regmi.
The JC had conducted an investigation after the same group of abductors was found to have abducted Dr Bhaktaman Shrestha.
Based on the abductors’ statement to police that they had kidnapped Dr Shrestha to collect money for settling their case pending at the KDC, a probe panel under then Judge Bala Ram KC had investigated Dr Shrestha abduction case, recommending Bam’s impeachment and action against judge Karki.
