SC stays CIAA action against seven IoM doctors

KATHMANDU: The Supreme Court on Friday issued an interim order in the name of Commission for the Investigation of Abuse of Authority (CIAA) to stop its action against seven doctors affiliated with the Institute of Medicine, Tribhuvan University Teaching Hospital (TUTH). A single bench of Justice Dr Ananda Mohan Bhattarai observed that the anti-graft body had initiated action against the seven doctors going beyond its jurisdiction. Justice Bhattarai further issued a show-cause notice to the defendants including CIAA and TU officials. After the Tribhuvan University's Registrar sought clarification from them for the second time over alleged improper conduct as per the CIAA's directive,  Dean of the Institute of Medicine Prof Dr Bimal Kumar Sinha, Assistant Dean Dr Sharad Onta, Prof Dr Jagadish Prasad Agrawal, Dr Dinesh Binod Pokharel, Dr Madhu Devkota, Dr Krishna KC and Vice-Principal Raj Devi Adhikari moved the apex court on Thursday seeking the apex court's intervention into the case. In a writ filed at the Supreme Court on Thursday, the seven doctors have claimed that the CIAA action was biased and not on a par with the existing laws. The petitioners have claimed that the CIAA action was an act of vengeance as CIAA Commissioner Raj Narayan Pathak's daughter Dr Priya Pathak, who failed the entrance exams, was denied admission to the IoM's post-graduate course. The CIAA Commissioner had allegedly exerted pressure on the IOM Dean and the Assistant Dean to admit his daughter. Later the CIAA allegedly initiated an investigation into the IoM officials' involvement in verification of documents and MBBS seat fixation in the Gandaki Medical College. The CIAA had written to the TU to take action against them with a conclusion that they had failed to carry out their assigned duties effectively.
