KATHMANDU: The Supreme Court on Friday has again put off the hearing on the re-polling case at Bharatpur Metropolitan City-19. The case which was listed on a cause list of a joint bench of Justice Mira Khadka and Anil Kumar Sinha has been rescheduled for July 10, citing a lack of time to look after the case. Earlier, a divisional bench of Acting Chief Justice Gopal Prasad Parajuli and Justice Hari Krishna Karki had on June 20 asked the Election Commission to submit the torn ballot papers and the ‘original decision’ of EC to conduct re-polling in the area. The Election Commission on June 3 had ordered the re-polling in ward 19 of Bharatpur Metropolis following the tearing of as many as 90 ballot papers with votes by two CPN Maoist Centre cadres on May 28, 2017 during the counting of votes. Following the Supreme Court order, the torn ballot papers were submitted to the SC on June 27 itself. After the local level elections held in Chitwan district, including Province 3, 4 and 6 on May 14 on the first phase, the tearing of ballot papers there had halted the vote counting and the Election Commission had ordered re-polling citing the vote counting area was illegitimately taken under control. However, ward 19 member candidate of CPN UML Gunja Man BK and Advocate Tulasi Ram Pandey had challenged the EC decision at the apex court on June 4, 2017.
