Court cannot issue order to Prez

KATHMANDU: The Office of the President on Wednesday told the Supreme Court that court ruling was impossible to direct the Head of the State in relation to any case.

“Since the President is the Head of the State, the apex court cannot direct him through its

quo warranto order,” the office claimed.

It was responding to a show cause notice of the Supreme Court that sought the explanation on why the President did not execute the verdict of the Supreme Court issued on July 24 in relation to administer fresh oath in Nepali to Vice President Paramananda Jha.

“The President did not perform any act going against the existing Interim Constitution of Nepal, 2007 in relation to the administering oath of office to the Vice President,” Baman Prasad Neupane, secretary of the Office of President claimed in the written explanation.

He further claimed that the quo warranto writ could be issued to anybody or any authority when the latter exercised power beyond the authority given.

While Jha did not take fresh oath in Nepali as per the verdict of the Supreme Court issued on July 24, another writ petition — demanding quo warranto order was filed. Petitioner Nawa Raj Neupane moved the apex court demanding intervention to execute its earlier verdict.

“When the Office of the Prime Minister and Cabinet suggested suitable time before Monday (August 30) to organise the oath, the Office of the President had written to the Prime Minister to organise the ceremony after coordinating with the Vice President.
