Govt says SC has no say in constitutional appointments

Kathmandu, December 16:

Minister for Law, Justice and Constituent Assembly Affairs Dev Gurung today told the Supreme Court that it didn’t need to intervene to prevent appointment to the constitutional bodies prior to the promulgation of Constitutional Council Procedural Act.

Submitting a written explanation before the apex court, he said there was no need of intervention as there existed a constitutional practice of making appointments in the constitutional bodies without the promulgation of the Act. “Since we have developed a constitutional practice to appoint officials to constitutional bodies through the recommendation of the Constitutional Council, the claim holds no ground,” he said.

Advocate Madhav Kumar Basnet had filed the petition seeking SC order to prevent appointments before the promulgation of the Act.
