Supreme Court scraps habeas corpus writs filed by detained doctors

KATHMANDU: The Supreme Court on Monday scrapped 10 habeas corpus writs filed on behalf of the doctors who are detained on charge of using fake certificates.

A division bench of Acting Chief Justice Sushila Karki and Justice Govinda Kumar Upadhyaya issued scrapped the writs, SC Joint-Spokesperson Bishwaraj Paudel said.

"There is no situation to conclude that the doctors detained for possessing fake certificates are arrested illegally and with ill intent," the verdict read.

The 10 doctors on whose behalf the habeas corpus writs were filed are: Nimesh Pal Raman, Panna Lal Prasad Patel, Binita Mandal, Punam Karna, Irshadul Haq, Shri Ram Ghimire, Ram Kumar Pradhan, Santosh Kumar Jha, Mohammed Rahullah and Saroj Kumar Singh.

They were among the 36 doctors arrested by Central Investigation Bureau of Nepal Police under its Operation Quack.

The writ petitioners had said that the doctors were arrested without being served any arrest warrant.

After the apex court order today, police have been allowed to carry out the investigation while not releasing the doctors.
