Supreme Court moved against RCCC

Kathmandu, August 10:

Days after the Supreme Court said a bench of judges would examine the constitutionality of the Royal Commission for Corruption Control (RCCC), advocate Shantosh Kumar Mahato today filed a writ petition at the apex court, challenging the extension of the RCCC’s term.

Mahato claimed that the King had extended the RCCC’s term by invoking the Article 127 of

the Constitution even after the state of Emergency was lifted.

He claimed neither it was constitutional to form such a commission with the power to investigate, prosecute and decide any case, nor was it constitutional to extend its term after the lifting of the Emergency. “As per the Constitution, all emergency orders should be lifted once the emergency is lifted.”
