DHANGADI, JUNE 10

A writ petition has been filed at the Supreme Court against Sudurpashchim government identifying the offices of the governor and chief Minister as defendants. The petition describes the government's act of reshuffling the province Cabinet as a move against the constitution.

As per the constitutional provision, the province governor, upon the chief minister's recommendation, can appoint ministers in keeping with the statutory provision that says, among other things, that the ministers' number should not exceed 20 per cent of the total strength of the provincial assembly.

'The decision to appoint 11 ministers from the PA that has a total of 53 PA members is clearly beyond the statutory ceiling, hence the case,' said Kamalsingh Rana, who was one of the three persons who filed the writ seeking that the government vacate its decision.

Rana, along with advocate Apekshya Niraula and law student Suresh Rokaya, filed the writ.
