Justices divided over case of Home Minister Lamichhane

KATHMANDU, JULY 4

Justices of Supreme Court (SC) Sapana Pradhan Malla and Saranga Subedi have furnished diverse views on whether or not Deputy Prime Minister and Home Minister Rabi Lamichhane should resign on his alleged involvement in the misappropriation of cooperative organizations' funds.

As the two Justices share dissimilar views, the case would be recorded in the full bench of three or more Justices now.

Legal practitioner Anupam Bhattarai had lodged the writ petition at the SC seeking a verdict for Lamichhane's dismissal from the post of the minister claiming that DPM Lamichhane was involved in the misappropriation of the cooperative organizations' fund.

SC Justice Malla on Thursday made a mandamus order in the name of the investigating agency for a fearless, impartial and independent investigation in the case lodged against Home Minister Lamichhane.

However, SC Justice Subedi has issued the mandamus order stating that Deputy Prime Minister and Home Minister Lamichhane should pave the way realizing the moral duty.
