Hearing on RCCC case

Kathmandu, November 15:
The hearing regarding the constitutionality of the formation of the Royal Commission for Corruption Control (RCCC) continued today. The apex court said the hearing on the case would be held next week.
During today’s hearing, former Attorney General Krishna Ram Shrestha pleaded on behalf of the RCCC, claiming that the SC cannot examine the RCCC, which was set up by the King.
A five member bench of justices Kedar Prasad Giri, Min Bahadur Rayamajhi, Ram Nagina Singh, Anup Raj Sharma and Ram Prasad Shrestha have been examining the legality of the RCCC.
Shrestha also claimed that since the King has not set qualifications for the RCCC officials, nobody has the right to raise the level of their qualifications. He said the formation notice by the King does not say there should be judges and lawyers in the RCCC to hear graft cases.
Advocate Mithilesh Kumar Singh said the apex court cannot test the King’s intent. “The apex court cannot examine such an issue which should be settled by the lower court,” he said.
