Case filed demanding annulment of some provisions of HoR Regulations

Kathmandu, July 15 Advocate Lokendra Oli and Ram Chandra Gautam today filed a writ petition at the Supreme Court demanding annulment of some provisions of newly passed House of Representatives Regulations. They have argued that the HoR rules that save lawmakers accused of a crime carrying a jail sentence of three years or more from suspension should be annulled as those rules contravened the constitution. The HoR rules states that a lawmaker accused of crime carrying a jail sentence of three years or more will not face suspension but will be barred from working as a lawmaker and will also be deprived of his/her pay and perks. The petitioners have said that unless a lawmaker accused of a crime is not suspended, the police cannot probe against him effectively. They have said that the HoR rules only state that if a lawmaker faces jail sentence after a final conviction verdict has been delivered, then such a lawmaker will face suspension which means if such a lawmaker serves his jail term before his tenure as a lawmaker ends, that lawmaker can still return to the Parliament. The petitioners have demanded that this provision too be annulled.
