SC quashes interim order against NAC

Kathmandu, August 14 The Supreme Court today quashed its interim order passed against the decision of Nepal Airlines Corporation to terminate its contract with Devman Hirachan that made him NAC’s local sales agent in Japan. Today’s order was passed by a division bench of justices Ishwar Khatiwada and Bam Kumar Shrestha in response to a writ field by NAC seeking nullification of the SC’s stay order passed on July 24. The SC observed that NAC had sought explanation from Hirachan on June 4 for not meeting contractual obligations. But, Hirachan did not respond to the letter. The court said that Hirachan later wrote to NAC on July 10 but, did not mention anything about the issues raised by NAC in its June 4 letter. On July 15, NAC appointed Aviation Japan Co Ltd as its local representative in Japan. Hirachan did not file a case making AJ Co Ltd a defendant. This is a contractual issue and it cannot be entertained under writ petition laws. The SC quashed its stay order passed by a single bench on July 24, keeping in mind the balance of convenience. The court observed that if it continued the stay order, it could affect NAC’ flights and could thus cause irreparable loss to the national flag carrier.
