Plea to bar elected candidate from CA

Kathmandu, April 20:

Demanding that an elected candidate of the Nepal Sadbhawana Partry (Mahato), Saroj Yadav, be barred from the Constituent Assembly, a case was filed at the Constituent Assembly Court today.

Seeking an interlocutory suspension order from the court to bar Saroj Yadav, who was elected from Bara-1, from the Constituent Assembly, defeated candidate Rambabu Prasad Yadav filed the case. This is the first time a case has been filed in the court against a CA member.

The petitioner, who contested the election on the ticket of the Madhesi Jana Adhikar Forum-Nepal, claimed that the District Election Office and the Election Commission have declared Saroj Yadav member of the CA illegally. He accused the NSP (M) candidate of being involved in rigging and booth-capturing. The MJF candidate urged the court to conduct repolling in A and B polling centres of Haripur Polling Centres of the Nepal National Primary School Naika Tola (a), Panna Devi Kanya Secondary School’s polling centre in Haripur VDC and Nepal National Primary School Naika Tola (b).

According to the petitioner, security forces and polling officers had let the NSP (M) candidate indulge in irregularities.

The petitioner demanded that the court issue an interlocutory order to bar the NSP (M) candidate from the CA till it gives its final verdict on the petition.

The petitioner sought court order to the defendants — returning officer of the district Prabhu Lal Shreevastav, polling officer Gopal Thakur, District Election Office and the Election Commission, Kantipath.

The CA court has issued summons to the defendants to attend the court within seven days and defend the allegations. The court has scheduled a hearing tomorrow to deliberate on whether or not to issue an interlocutory suspension order.
