SC begins hearing on Silwal’s case

Kathmandu, July 6

The Supreme Court began hearing the case filed by DIG Nawa Raj Silwal challenging the government decision promoting Prakash Aryal to the post of Inspector General of Nepal Police.

The case is being heard by a seven-member full bench led by Acting Chief Justice Gopal Parajuli. Other members of the bench are justices Om Prakash Mishra, Kedar Prasad Chalise, Sharada Prasad Ghimire, Mira Khadka, Prakash Man Singh Raut and Purushottam Bhandari.

The bench is also hearing a case filed by Prakash Aryal demanding that he should also be considered for promotion to the post of IGP.

Senior Advocate Shambhu Thapa pleaded on behalf of DIG Silwal, saying the five criteria for promoting a DIG to the post of IGP were a matter of objective and not subjective evaluation.

He also said Aryal had not submitted his performance evaluation file before July 23, 2015, the deadline set by the law and thus he was not fit for evaluation.

The government has submitted its written reply on the case accusing DIG Silwal of submitting fake performance evaluation file. DIG Silwal said in his writ petition that he should be promoted as IGP as he had the highest score in the performance evaluation report.

Advocate Bal Krishna Neupane also pleaded on behalf of Silwal. The next hearing is scheduled for August 3.
