Dissolution of commission on land problems stayed

The Supreme Court on Monday issued a temporary interim order against the government’s decision to dissolve the Land Related Problems Solving Commission.

KATHMANDU, AUGUST 9

The Supreme Court today issued a temporary interim order against the government's decision to dissolve the Land Related Problems Solving Commission.

A single bench of Justice Ishwar Prasad Khatiwada ordered the government not to make changes in the record related to the work and activities of the dissolved Land Related Problems Solving Commission, the commission's physical resources and means, and work related to the management of the commission till August 17. The bench issued the order in response to a writ petition filed by the dissolved commission's Chairman Devi Prasad Gyawali against the government. The apex court also asked both the plaintiff and defendants to appear before the court on August 17 to present their arguments on whether or not an interim order should be issued in the case.

The bench also issued a show cause notice to the government.

A Cabinet meeting held on August 3 had dissolved the commission. The KP Sharma Oli government had formed the commission on 22 March 2020 with the aim of providing land to landless people across the country and to manage informal settlers. It had a tenure of three years. The CPN- UML has opposed the dissolution of the commission, saying it would deprive the intended beneficiaries of their fundamental rights.
