Home Ministry urges dignified use of national flag, warns of legal action for misuse

The Ministry of Home Affairs has urged the public to use Nepal's national flag in a dignified and respectful manner, warning that legal action will be taken against any misuse in violation of existing laws and procedures. In a press release issued on Sunday, the ministry said the 'Procedure on the Use of the National Flag and the National Anthem, 2069' is being implemented to ensure the systematic, dignified, and respectful use of the national flag, a symbol of national pride. The ministry stated that provisions under the procedure regulate the size, method of use, hoisting, and prohibitions related to the national flag. It also noted that Chief District Officers are mandated to regularly monitor whether the flag is being used in accordance with the procedure within their respective jurisdictions. According to the ministry, acts such as displaying the national flag upside down, tearing, burning, throwing it away, using it to wrap goods, or misusing it for commercial or advertising purposes are strictly prohibited. The press release also bars wearing or printing the national flag or its symbol on the body below the waist or chest, or in any manner that undermines its dignity. Referring to the Election Code of Conduct, 2078, the ministry said political parties or candidates are allowed to use a maximum of 10 national flags during rallies, processions, or campaign activities, and that misuse of the flag for election publicity is punishable by law. The ministry further cited provisions of the National Penal Code, 2074, which prohibit insulting the national flag or using it in places or situations that violate public morality, decency, or propriety, with penalties prescribed for violations. Emphasising that the national flag represents the nation's pride and sovereignty, the Home Ministry called on all individuals, organisations, and political actors to strictly adhere to prevailing laws while using the national flag. It warned that any misuse would invite action in accordance with the law.
