SC stays decision to dissolve trade unions

KATHMANDU, MAY 12 The Supreme Court (SC) has issued an interlocutory order staying the government's decision to dissolve trade unions in state-run institutions. A joint bench of Acting Chief Justice Sapana Pradhan Malla and Justices Kumar Regmi and Hari Prasad Phunyal issued the order on Monday. However, Justices Binod Sharma and Sharanga Subedi, on the constitutional bench, expressed dissenting views on granting the stay. The court has summoned both parties for a hearing on May 20 and directed the Office of the Attorney General to submit a written response along with a copy of the writ petition within seven days of receiving the notice, excluding travel time. The writ petition was filed by Bhawani Dahal, chairperson of the Nepal Civil Service Employees' Organisation, among others, naming the Office of the President as a defendant. Earlier, the SC also issued an interim order to halt the implementation of a decision to dissolve student organisations at universities, on Monday. A single bench of Justice Shreekanta Paudel issued the order, directing authorities not to enforce the decision immediately. The court has scheduled a hearing on the case for May 18. The writ petition was filed by leaders of various student bodies naming the Office of the Prime Minister and Council of Ministers as the defendant.
