CA discusses judiciary panel's proposal

KATHMANDU: Constituent Assembly members representing various political parties today reiterated their party's view on the new proposed constitutional provision on Judiciary. The CA has started discussion on the report of its Committee on Judiciary since yesterday.

The Unified CPN-Maoist, Madhesi Janadhikar Forum and few other lawmakers are in favour of the proposed provisions while other parties, including Nepali Congress and CPN-UML, are opposing some provisions citing that they are against the principle of judicial independence.

Dev Gurung of UCPN-M said they proposed the provision in order to bring the judiciary under people's control. "The present judiciary is out of the people's access and is biased and impractical. The new provisions will make it democratic and accountable to the legislature, the people's representative body."

Arjun Prasad Joshi of NC said the proposed provisions did not fit the Nepalese context and were against democratic norms. Agni Kharel of CPN-UML said the judiciary could fall prey to the political party having majority in the CA if the proposed provisions were made part of the new constitution. The provisions are against the principle of constitutional supremacy and independent judiciary, he noted.
