Jha to move SC for active VP

KATHMANDU: Paramananda Jha, who had been rendered inactive by the apex court to exercise his authority as the Vice President, is all set to move the Supreme Court pleading to regain his authority.

Jha came into limelight after the apex court annulled his oath of office and secrecy. Jha had to vacate his post following his refusal to comply with the court's order to retake the oath of office in Nepali.

A close aide of Jha told The Himalayan Times today that he was contemplating over moving the Supreme Court, seeking to get back in action as vice-president.

"He is preparing to request the apex court not to issue an order while passing the final judgment in the quo warranto writ thereby allowing him to remain active VP," Jha's aide said, speaking on condition of anonymity.

Jha is said to have prepared a written explanation in this regard which is likely to be submitted to the SC on Sunday.

Jha's aide also added that since the petition was still sub-judice in the Supreme Court, the defunct vice president continues to enjoy state facilities, including security, and the national flag is still hauled up at his residence in Gaurighat.

In his written explanation to the apex court, Jha will plead formally that he would retake oath in Maithili language, instead of Nepali or Hindi, only after the Legislature-Parliament endorsed the seventh amendment bill to the Interim Constitution of Nepal, 2007.

"He would take fresh oath in Maithili after the amendment," Jha's aide added.

While vacating his Office, Jha has condemned the Supreme Court of being biased against him and said its ruling infringed on his fundamental rights to use his mother tongue.

Filing a review petition last Friday, Jha urged the apex court to consider the verdict passed on July 24 that has annulled his swearing-in in Hindi language.

He also added that the judgment misinterpreted the Interim Constitution of Nepal and also violated its precedents. However, the apex court had refused to accept a review petition on the August 23 order.

Law Minister Prem Bahadur Singh, however, claimed that the security has not been provided to Jha with his capacity of defunct Vice President but said it was the duty of the government to provide him a security as a citizen of the nation. “When common citizens got it, why not the VP?” he asked.
