Local levels required to publish gazette

The government has issued the Procedure on Publication of Local Gazette to prescribe the format and descriptions of the Local Gazette.

Section 102 of the Local Government Operation Act requires the local levels to publish in the Local Gazette all laws, rules, directives, procedures and standards for their authenticity and date of commencement. The procedure presents subject matters and parts to be included in the Local Gazette.

“The executive of municipality or rural municipality shall assign a section or unit of the local level for publication of the Local Gazette by setting out its job descriptions and responsibility,” the procedure says.

Before publication of the Local Gazette, legal section of the concerned local level will have to edit the paper to ensure it is consistent with requirements stated in the procedure.

“Upon authentication of the Local Gazette by the executive, it shall be sent to the printing section. The local levels have to maintain records of each Local Gazette,” it reads. The concerned municipality or rural municipality shall provide copies of the Local Gazette to the Government of Nepal and the provincial ministry overseeing federal and local affairs, information and record centre of the local levels, and ward office free of charge.

The local levels are also required to publish the Local Gazette on their website. “Any person or organisation willing to obtain the copies of the Local Gazette should pay Rs 5 to Rs 50 depending on the number of pages,” the procedure says.

The amount collected from the sale and distribution of the Local Gazette shall be deposited in the consolidated fund of the concerned local level.
