Municipal executive regulation issued

The Ministry of Federal Affairs and Local Development has issued model ‘Municipal Executive (Work Division) Regulation, 2017.
The MoFALD said it issued the regulation by exercising the powers conferred on it by Article 218 of the Constitution of Nepal. It has so far issued 10 separate model laws to facilitate the local levels in making their own rules and regulations in line with the laws in force.
According to the regulation, performance of municipal executive shall be executed from its office, ward office and thematic sections. The thematic sections and their job specifications shall be approved by the municipal executive.
“The municipal executive may make changes in the functions of the thematic sections. Chief of the municipal executive may assign any responsibility to any member by also determining his/her jurisdiction,” read the regulation.
Similarly, the executive may form a thematic committee under the coordination of any member and fix the jurisdiction of such committee. Chief and members of the municipal executive shall be accountable to the municipal assembly collectively for any task executed by it. “The members of the municipal executive shall be responsible to the executive and its chief for the task assigned to them,” it said.
The municipal executive may delegate some powers to its chief, deputy chief, members, committee or sub-committee under its aegis or executive officer. Similarly, chief of the municipal executive may also follow the suit.
“The municipal executive may make alterations and amend this regulation as necessary. While doing so, it shall publish a notice with respect to such alterations or amendment for the information of general public,” read the regulation.
If any difficulty arises in the course of implementation of the regulation, the executive may make necessary provisions to remove such difficulty.
