SC order sought for constitutional bodies

Kathmandu, November 26

Seeking the Supreme Court order to government authorities to enact necessary laws before making appointments in constitutional bodies, a group of advocates today filed a writ petition at the apex court.

Through the petition, the advocates are seeking SC order to bar appointments in constitutional

bodies without the enactment of the Act. They also claimed that the Act was required as per the Article 149 of the Interim Constitution.

Through the petition — filed jointly by advocates Madhav Kumar Basnet, Lok Dhoj Thapa and Binod Phuyal — the petitioners have demanded Supreme Court order to the Prime Minister, Prime Minister’s Office and Cabinet, the Chief Justice, members of constitutional bodies, speaker of the Legislature-Parliament, Deputy Minister and a number of ministries to prepare procedural law before making appointments in constitutional bodies.

The petitioners also sought the Supreme Court intervention to appoint the chairman and members of the constitutional bodies, saying that the constitution has clearly stated that the government should enact laws before making appointment in constitutional bodies.

Advocate Shakuntala Thapa on Wednesday requested the jailor of Central Jail to provide a confidential environment. Thapa filed a petition at the Central Jail and added that the jail authorities had allocated her only ten minutes to discuss legal matters.
