SC reinstates Gurung in NAC

KATHMANDU: The Supreme Court today reinstated managing director of Nepal Airlines Corporation (NAC) Kul Bahadur Limbu revoking two-year-old decision of the government to transfer him in the Ministry of Tourism and Civil Aviation.

A division bench of Justices Bala Ram KC and Girish Chandra Lal revoked the decision stating that the government does not have authority to transfer him in the Ministry for the 'unsuitable post'.

The bench also issued a mandamus order to the government to reinstate him in his previous post and give authority to him by issuing Terms of Reference (ToR).

He was transferred to the Ministry after appointing Sugat Ratna Kanshar for the post of executive director on December 26, 2008. Following the decision, both the executive director and the managing director shall work in the NAC.

While appointing Kanshakar to the post of executive director, the government had also given the managing director's portfolio to him. The bench also directed the government and the board of directors of the NAC to provide him the authority over the reinstated post. "Since such a responsible post of the NAC cannot remain without any work therefore give him proper authority," the bench directed.
