SC notice to Province 3 assembly, EC

The Supreme Court today issued a show cause notice to the Province 3 assembly and the Election Commission in a case filed by two Provincial Assembly members of the province —  Biraj Bhakta Shrestha and Ramesh Paudel — seeking nullification of a letter written by Rabindra Mishra-led Bibeksheel Sajha Party. The party has sought to recall the duo from the PA.

Bibeksheel Sajha Party recently wrote a letter to the Province 3 assembly informing it of the party’s decision to recall Shrestha and Paudel, elected under proportional representation electoral system when the party was united. The two PA members joined Bibeksheel Nepali Party when it split from Bibeksheel Sajha Party few weeks ago, but Bibeksheel Sajha claimed that it had expelled 16 central committee members who had split from the mother party to form Bibeksheel Nepali party. The SC also summoned both sides to present their argument on whether an interim order should be issued as demanded by the petition.

Bibeksheel Nepali Party Spokesperson Milan Pandey told THT that Bibeksheel Sajha Party had no rights to recall the two PA members as they had joined the splinter party. “The EC did not recognise our party arguing that we did not have the support of 40 per cent of the central committee members. Thus, we moved the court against the EC’s verdict,” Pandey said.

The notice was issued by a single bench of Justice Hari Krishna Karki in a case filed by Shrestha and Paudel.
