Writ against proposal in house not registered

Registrar of the Supreme Court today refused to register a writ of certiorari and mandamus that challenged the moving of a proposal of public importance in the Parliament against Chief of the Commission for the Investigation of Abuse of Authority Lok Man Singh Karki and CIAA member Raj Narayan Pathak.

Registrar Shree Kanth Paudel, attaching reasons for refusal to register the writ, said the issue was a matter of Parliament’s privilege and hence the SC could not entertain it.

Petitioner Parmatma Nepal stated in his petition that the movers of the proposal of public importance wanted to indirectly initiate a debate of impeachment in the house, which was not supported by any constitutional provision.

The petitioner also stated that any debate of impeachment could take place in the House only when an impeachment proposal and not a proposal of public importance is registered there.

“The allegation of impeachment cannot be labelled as going against anybody just because somebody does not like somebody,” the petitioner stated in the writ.

The petitioners had named lawmakers Gagan Kumar Thapa, Dhana Raj Gurung, Shyam Shrestha, the Speaker and the Parliament Secretariat as defendants.
