Apex court asks govt to set up verdict execution units in ministries

KATHMANDU: The Supreme Court today directed the government to set up verdict execution units in all ministries.

A division bench of Justices Bala Ram KC and Krishna Prasad Upadhayaya issued the order to the government authorities — the Prime Minister's Office and Cabinet, Office of the Attorney General and Planning Division of Supreme Court — to set up units in the ministries to execute the order.

The bench has given four-month time for the ministries to set up such units. Such units are required to begin the process of execution of verdicts and to duly report the apex court regarding their work in this regard.

The order comes in response to a Public Interest Litigation filed by advocate Meera Dhungana on behalf of the Forum for Women, Law and Development seeking the apex court intervention last year.

In its directives, the apex court, however, granted the government authorities for demanding reasonable time to execute the verdicts if they could not do so in the given timeframe. "Giving reasonable ground the time can be extended filing application through the Office of the Attorney General," the bench said.

"Since there were no such mechanisms in the government to execute verdicts, the orders could not be implemented as required by the constitution," the bench observed.

Citing the non-execution of more than 150 directives, the petitioner had moved the apex court last year stating that due to the lack of responsible mechanism in the government offices, the verdicts were pending.

The apex court had issued around 400 popular verdicts in relation to PILs but one third of the total verdicts could not be executed.

Advocate Dhungana welcomed the apex court bid to implement the verdict saying that it gave a ray of hope in executing the verdicts.
