In the absence of the House of Representatives, there is no clear authority as to who will take action against a Supreme Court justice. But senior jurists today suggested Chief Justice Govinda Bahadur Shrestha to bring into operation Article 93 of the Constitution and take action against justices who are involved in irregularities. Senior advocates, during the meeting organised by the apex court, suggested that the CJ forward the report to the Parliament Secretariat after probing any case involving a Supreme Court justice. "Since the National Assembly is in existence, formality can be maintained by sending the report," they argued. "They also supported the ongoing investigation conducted by a three-member panel of Supreme Court justices regarding the release of British druglord Gorden William Robinson," said a source.

Former speaker and senior advocate Daman Nath Dhungana, former minister and senior advocate Basudev Dhungana, former attorney-general and senior advocate Sarbagya Ratna Tuladhar, senior advocate Sindhu Nath Pyakurel, Nepal Bar Association president Shambhu Thapa and secretary Madhav Banskota participated in the meeting. Chief Justice Shrestha and some senior justices, including Hari Prasad Sharma, were also present. They opined that though the 1990 Constitution did not provide power to other bodies except the House of Representatives, this does not mean that the Article bars Judicial Council from probing any case involving a Supreme Court justice.
