Person filing charge sheet fails to record statement at court

Nur Prasad Adhikari, the person who had filed the charge sheet regarding the murder case of Krishna Prasad Adhikari of Fujel, Gorkha, failed to appear at court to record his statement. He was required to present himself at Chitwan District Court to record his statement today, but he failed to make it to the court.
Earlier, on February 25, Judge Kul Prasad Sharma had ordered Nur Prasad, who filed charge sheet to present himself at the court to record his statement in relation to the murder case.
“As he could not be contacted, the notice bearing the court’s order had been pasted at a public place in his village,” said court Registrar Gehendra Panta. As per the notice, Nur Prasad was to present himself at the court today, but he has simply missed the date . “As he didn’t come to court today, when the case will be heard will be decided tomorrow,” the registrar informed.
It is interesting to note that hearing on the case is being postponed time and again. It’s been four years since the case was registered at the court and one-and-a-half years since arguments of lawyers representing either side of the case were heard.
Krishna Prasad was murdered on 6 June 2004 in Chitwan, where he had come to meet his grandparents. The then Maoist rebels had taken responsibility for the murder. Just two days after the incident, Krishna Prasad’s father Nanda Prasad had filed a complaint at the district police office, Chitwan, regarding the murder, following which one year later, on December 11, the murdered man’s brother Nur Prasad had filed a charge-sheet mentioning 13 persons as the murderers at the same police office. Of them, police had arrested 11 persons, seven of whom were released on bail while the rest were released on normal date. Two others are yet to come into contact with the court.
As there were no proceedings on the case for long, Krishna Prasad’s parents had started fast-unto-death. His father Nanda Prasad, who refused to end his protest, lost his life on 22 September 2014 during his fast-unto-death. Krishna Prasad’s mother Gangamaya is still continuing her fast-unto-death.
