Appeal court scraps case against CJ

KATHMANDU: The Patan Appellate Court today turned down a petition filed demanding action against Chief Justice Min Bahadur Rayamajhi and Justice Bharat Raj Upreti.

A single bench of Judge Mohan Prakash Ghimire scrapped the petition that was registered yesterday demanding legal action against Rayamajhi and Upreti accusing them of accepting two different writ petitions against Vice President Paramananda Jha in his oath row and directing him to take fresh oath in Nepali or be eased out from his post automatically.

The bench said the petition could not proceed since the petitioner had not exercised alternative remedy.

Advocate Roshan Kumar Bhatta had filed the petition in the Patan Appellate Court seeking its order to Metropolitan Police Range Hanumandhoka, Regional Police Kathmandu and Kathmandu District Administration Office to register the first information report against Rayamajhi and Upreti to proceed a case on forgery.

"Since the petitioner moved the court without approaching higher police authority, there is no need to take up the issue by this court," the bench stated while annulling the petition.
