Don't follow Speaker's letter, orders Supreme Court

KATHMANDU: The Supreme Court on Monday ordered the Judicial Council not to implement the letter sent by Speaker Onsari Gharti Magar which mentioned that the House could not immediately hold parliamentary hearing on nominees of the SC justices.

Issuing an interim order today, a single bench of Justice Jagadish Sharma Paudel also told the Legislature-Parliament to conduct the hearing as soon as possible.

Advocate Jyoti Baniya on Friday had filed a writ at the apex court demanding that the Speaker's letter is not implemented.

Baniya had made the Parliament, the President's Office and the Office of the Prime Minister and Council of Ministers defendants in the case.

A few days ago, the JC had nominated new 11 justices Dipak Karki, Kedar Chalise, Sarada Prasad Ghimire, Meera Khadka, Hari Krishna Karki, Bishwambhar Shrestha, Ishwar Khatiwada, Anand Mohan Bhattarai, Anil Kumar Sinha, Prakash Man Singh Raut and Sapana Pradhan Malla.

Speaker Gharti, however, had written to the JC that the recommendation could not be forwarded immediately for the parliamentary hearing in absence of the Parliamentary Regulations and the Parliamentary Hearing Committee.
