KATHMANDU, MAY 24

The opposition-alliance has filed a writ petition at the Supreme Court demanding reinstatement of the House of Representatives.

Leaders of the alliance moved the court two days after President Bidya Devi Bhandari dissolved the House in compliance with Oli-government, citing that the act was unconstitutional as there was a legal room for appointment of a new government as per Article 76 (5) of the Constitution of Nepal.

In the writ, petitioners have demanded that NC president Sher Bahadur Deuba should be, lawfully, appointed the Prime Minister in accordance with Article 76 (5).

Their other demands include reinstatement of the House, scrapping of the announcement of election in November, to stop election related programmes amid the raging second wave of Covid-19 pandemic, and to issue an order to summon House meeting to facilitate presentation of the budget within the time provisioned by Constitution of Nepal.

Former lawmakers from the opposition parties had assembled in Singha Durbar on Sunday and on Monday to submit their signatures endorsing Nepali Congress President Sher Bahadur Deuba's claim to Prime Ministership.

It has been learnt that 26 leaders from PM KP Sharma Oli's rival faction have submitted their signatures.

Deuba had staked his claim to government on Friday claiming that he has the support of a 149-lawmaker-strong majority alliance.

The parties in opposition on Saturday had convened a meeting to discuss their strategies forward and had decided to unitedly fight the unconstitutional, regressive, autocratic move of the government by every political and legal means possible.

The country was ushered into a new episode of uncertainty amid the raging second wave of Covid-19 pandemic as PM Oli and NC President Deuba filed their respective claims for premiership - both announcing that they command support of the majority of lawmakers, which created a situation of improbable mathematics.

Later, on the same day, President Bhandari had rejected claims of both the candidates' stating they fell short of required provisions, thereby paving way for PM Oli to forward recommendation to dissolve House.
