KDC verdict execution at a poor 49pc

KATHMANDU: Almost half the verdicts issued by Kathmandu District Court (KDC) within the past year remained ineffective due to their non-execution.

The KDC annual report for the fiscal year 2008/09 states that 49 per cent verdicts could not be executed due to non-cooperation from stakeholders such as the police and local representatives.

The report, however, added that the percentage shows a slight improvement compared to the preceding ones. As many as 518 verdicts were executed last year.

The court has also got to collect Rs 2.47 million from convicts. Rs 80 million was collected as fine in the given period. Interestingly, only one person paid fine as notified.

Merely 31.02 per cent convicts were executed jail term in the period.

As many as 4,917 convicts were not jailed either

because they were

absconding or died after the verdict.

“Due to the non-

cooperation of local representatives, common

people and security agencies, verdict execution has turned out to be a difficult task,” states the report. The court also expressed the need for its own security agency for inffective implementation of the order.

The KDC sought judicial police for the purpose, allowances for the field staff, cooperation from local body representatives and financial institutions in order to freeze the properties of the persons whose property has been held.

“It is questionable that our judiciary could not implement the verdicts on time, suggesting an urgent reform in the judicial system,” Hari Prasad Uprety, vice-president, Nepal Bar Association, said. “It is saddening that a case takes long to be decided and half the verdicts are not be executed,” Uprety added.
