SC upholds CIAA jurisdiction

Responding to a habeas corpus challenging the jurisdiction of the Commission for the Investigation of Abuse of Authority (CIAA) to detain a person, the Supreme Court said today the anti-graft body has the authority to detain a person if s/he fails/refuses to pay bail amount.

Issuing the order, division bench of justices Bhairav Prasad Lamsal and Badri Kumar Basnet, said the anti-graft body has the right to impose the bail amount and to detain the accused. From now, the CIAA can detain anyone for six months in connection with corruption case. The habeas corpus was filed at the apex court seeking the release of businessmen Suresh Kumar Agrawal, Subodh Kumar Agrawal, Narayan Kumar Agrawal and Krishna Kumar Agrawal, who are kept at Singhdurbar Ward Police Office. They were detained for refusing to pay the bail amount.
