CJ Sharma against limiting apext court jurisdiction

KATHMANDU: Chief Justice Anup Raj Sharma today strongly opposed the idea to limit the jurisdiction of the Supreme Court (SC).

"The SC's authority can not be limited as we have expanded the same through the constitution," Sharma said while addressing a two-day conference of judges here. He also objected to the idea of limiting its power from exercising the Public Interest Litigation (PIL) under the apex court's extraordinary power.

All the SC justices, chief judges and judges of appellate courts have been participating in the conference that kicked off today. He added that since the apex court judges had dissenting opinions they could not impose any idea against it. Suggesting the judges to do away with political issues, NBA president Bishwo Kanta Mainali called them not to show judicial activism at the time of political impasse.

"The lawyers, who do not have any work, are moving the apex court with PILs; hence, the apex court should resist from such cases," he added. Mainali also said there would be a tsunami of PILs if the apex court continued accepting them.
