The Supreme Court has issued separate interim orders to the government telling it not to remove Executive Chairperson of Gorkhapatra Corporation Bishnu Prasad Subedi and Executive Chairperson of Nepal Television Samir Jung Shah before the final adjudication of their cases or before their four-year tenure ends.

A division bench of Justices Nahakul Subedi and Saranga Subedi issued the interim orders on Sunday in response to separate writ petitions filed by Bishnu Prasad Subedi and Samir Jung Shah challenging the show cause notice issued to them by MoCIT.

The bench observed that it was issuing interim orders to the government as MoCIT's show cause notice issued to the petitioners was prima facie wrong and balance of convenience was in the petitioners' favour.

Since there is no case for removal the petitioners from their job on grounds of the show cause notice and the clarification furnished by the petitioners, this bench hereby orders the government not to remove the petitioners from their post until the adjudication of the case or before they complete their terms, the bench observed.

Bishnu Prasad Subedi was appointed Executive Chairperson of Gorkhapatra Corporation on September 28, 2021 and Samir Jung Shah was appointed Executive Chairperson of Nepal Television on February 4, 2022 respectively. Both were appointed for four years. The bench also observed that MoCIT issued show cause notice to the petitioners at a time when their periodic evaluation had not been done.

Writ petitioners have named the Office of the Prime Minister, Council of Ministers and MoCIT as defendants, and others as defendants.
