SC tells govt to disclose public land
Kathmandu, September 13
The Supreme Court has directed the government to disclose details of all public land that have been given on rent.
A divisional bench comprising Chief Justice Kalyan Shrestha and justice Om Prakash Mishra ordered the government to make public which lands have been given on rent.
Noting that the government can utilise land in the public domain in its own interest, the apex court clarified that the government has the authority to take decisions regarding the purpose of use of such land.
The SC stated it could not prevent the government from bringing into practice its decision on utilisation of public land. The Supreme Court has also directed agencies including Ministry of Land Reform to disclose factual details of lands that have been given for rent.
With today’s ruling of the apex court, the avenue has been opened for the government to provide public land for lease.
On July 12, 2015, advocate Manju Tiwari had registered a writ petition at the apex court against the government decision to grant public land of the country for lease.
Apex Court dumps Bagmati Clean-up Report
KATHMANDU: The SC has disapproved a report regarding Bagmati clean-up submitted by a team including the chief secretary. SC Assistant Spokesperson Biswo Raj Poudel informed that the divisional bench comprising Chief Justice Kalyan Shrestha and justice Om Prakash Mishra on Sunday disapproved the report submitted to the court. Pro-Public had filed a contempt case citing that the directive issued by the court on Bagmati clean-up was not implemented. The SC had ordered the government to submit Bagmati clean-up related report every four months.
