Transfer of Special Court judges likely soon

The Judicial Council headed by Chief Justice Kedar Prasad Giri is likely to transfer the judges of the Special Court soon, as many of them were found to have issued clean chits to many corruption-accused people.

“They may be transferred soon,” a JC source told this daily today. Judges Bhoopdhoj Adhikary, Komal Nath Sharma and Cholendra SJB Rana have been working in the Special Court. Adhikary is the chairman, while Sharma and Rana are members of the anti-corruption tribunal. Adhikary has been working in the Special Court for five years. The two other judges have been working in the court for two years.

“We have the rule to transfer judges to remote districts and urban districts every two and three years,” secretary of the JC, Prakash Kumar Dhungana, said.

While assuming office, Chief Justice Giri had promised to restructure the Special Court and the Commission for the Investigation of Abuse of Authority.

“We don’t know what kind of restructuring the CJ wants, but the transfer of the judges is likely,” said the JC source. According to him, along with the Special Court judges, the transfer of Appellate Court and District Court judges is also possible because the JC has not transferred the judges of these courts in a period of two years.

The judgements of the Special Court became controversial as former ministers, former secretaries and former Inspector General of Police got clean chits. The CIAA had filed appeals in the Supreme Court challenging most of the clean chit verdicts. Supreme Court justice Anup Raj Sharma has recently observed the Special Court and examined the grounds of controversial verdicts.
