Writ filed at Supreme Court against CJ impeachment motion

KATHMANDU: Advocate Sunil Ranjan Singh on Wednesday filed a writ petition at the Supreme Court, challenging the impeachment motion that the lawmakers of ruling Nepali Congress and CPN Maoist Centre moved against Chief Justice Sushila Karki.

In his writ, the petitioner has claimed that the motion has breached the Articles 16.1, 177.1, 101.2, 101.6, 105, 126.1, 126.2, and 128.4 of Nepal's Constitution for it based on the SC verdicts and a sub judice case, and intended to assassinate the Chief Justice's character.

Singh said since it was a matter of public interest and there was no other way to challenge the move, he was filing the petition as per the Article 133.2.

Dubbing the allegations against the Chief Justice hypothetical, the petitioner claimed the impeachment motion was brought to influence the judiciary and with an intent to build a guided judiciary.

Nepali Congress and Maoist parliamentary parties, Parliament Secretariat and Speaker Onsari Gharti are defendants in the petition.

The apex court has fixed to hold preliminary hearing on the case tomorrow, Singh said.

With Acting Chief Justice Gopal Prasad Parajuli also as a defendant, Singh had prepared to file the writ yesterday.

He, however, dropped Parajuli's name in the petition today.
