Apex Court records Dr KC's statement on contempt of court case

KATHMANDU: The Supreme Court has recorded statements today from senior orthopaedic surgeon Prof Dr Govinda KC who is facing the case on contempt of court.

Dr KC, who was arrested on Monday from the protest spot at Tribhuvan University Teaching Hospital in Maharajgunj, was presented before the Supreme court this morning in line with the direction of the apex court to the Home Ministry and the police to this effect.

A division bench comprising judges Om Prakash Mishra and Kedar Prasad Chalise will conduct a hearing on the case following the completion of his statements. Senior advocates Krishna Prasad Bhandari and Dinesh Tripathi, and advocates Surendra Bhandari and Lekhanth Nepaune are pleading in favour of Dr KC.

Dr KC, through his statements, expressed that he should not be charged with contempt of court based on the opinions that he shared through the media.

In the statement issued, Dr KC has raised concerns addressing his demand for the resignation of the Chief Justice. He has stated that the age and educational qualification of the Chief Justice - which should be determinants to his remaining in the position - are unclear. He has also demanded the judicial council to investigate into the aforementioned issues.

Additionally, he has also raised issues about the decision Parajuli gave in the Jagdish Acharya case regarding regulations on systematic plotting of land.

He also questioned Parajuli's ethics regarding recommending himself as a candidate for the Chief Justice following the impeachment motion filed against the former Chief Justice Sushila Karki.

Meanwhile, the hearing of the case will continue tomorrow. Dr KC has been sent to the Metropolitan Police Circle, Singha Durbar.

Dr KC had begun the fast-onto-death demanding resignation of Chief Justice Gopal Parajuli in response to the Supreme Court’s decision to reinstate Dean of Institute of Medicine (IoM) Dr Shashi Sharma to the post.
