KATHMANDU, AUGUST 24

Kathmandu metropolis Mayor Balen Shah has asked KMC employees, teachers, and professors to renounce political affiliation and warned them of legal action if they don't.

According to the Patan High Court's Employee Service Act, the rule states that employees of metropolis should not have any party affiliation. Citing the Political Party Act, 2016, KMC Mayor Balen Shah directed employees, teachers, and professors through social media to renounce political affiliation with parties.

The following post was issued by Mayor Shah through social media this Morning: "In relation to the notification to employees to renounce party affiliation, Clause (c) of sub-section (2) of section 14 of the Political Party Act, 2016, party affiliation shall not be given to any professor, teacher or employee of an institution owned or controlled by the government of Nepal, provincial government or local level. In the case of Ajit Bhandari versus Prime Minister and Council of Ministers, a mandamus was issued by Patan High Court on 19 May 2022, to implement the said law.

Section 45 of the Kathmandu Metropolitan City Employee Service Act, 2020 also provides that no employee of the KMC can be in a political party or organisation, engage in political activities or participate in any other political activity.

It is the responsibility of KMC as well as every political party, fraternal organisation or voluntary organization and teachers and employees under KMC to comply with the said legal system and the order of the honourable High Court of Patan.

It is not lawful for teachers and employees of KMC to be members of any political party, fraternal organisation or voluntary organisation.

Therefore, it is earnestly appealed to the concerned political parties, fraternal organisations or voluntary organisations not to give any kind of membership related to party affiliation to the teachers and employees under KMC or to cancel the membership if they have been given membership.

In addition, teachers and employees under KMC who have maintained political affiliations as members of political parties, fraternal organisations or voluntary organisations are notified through this announcement to renounce such affiliations.
