The Supreme Court (SC) has ordered the imprisonment of suspended district judge Bhuvan Giri, who stands accused of rape.
The division bench comprising Justices Hari Prasad Phunyal and Til Prasad Shrestha reversed the rulings of both the District Court Kathmandu and the High Court Patan, rendering them void.
According to the order, "The physical examination report of the victim showed 'hymen old tear' related to the reproductive organ. Before this case, the victim and the defendant were waging a legal battle of rape and divorce," adding that it was unusual for the accused to visit the victim during such a time of dispute and legal proceedings.
Based on these circumstances and evidence, the order asserted that it cannot be concluded that the defendant is not guilty now.
Previously, both the District Court Kathmandu and High Court Patan had granted bail to the suspended judge Giri. However, following a complaint filed by Giri's wife alleging rape, the police arrested him and conducted further investigations.
Giri was suspended from his duties after the District Attorney's Office filed a case of marital rape against him. Meanwhile, during today's court proceedings, Giri's wife consumed a suspicious substance in the courtroom.
Supreme Court Co-spokesman Govinda Ghimire stated that she was taken to Bir Hospital for treatment after ingesting an unknown substance. However, it remains unclear what exactly she ingested.
