KATHMANDU, NOVEMBER 23
The Supreme Court (SC) has ordered the release of Durga Prasain, a medical entrepreneur and Coordinator of the Rastra, Rastriyata Bachau Abhiyan.
In response to a habeas corpus petition filed by Prasain's son, Nirajan, a division bench of Justices Nahakul Subedi and Shree Kanta Paudel directed authorities to immediately set Prasain free.
The Court stated that detaining Prasain solely for his expressions violated his constitutionally guaranteed right to freedom of expression.
The SC further noted that, in light of the Abhiyan's agreement with the government on Saturday to conduct its activities peacefully, additional investigation, continued custody, or extended procedures for further inquiry were unnecessary.
Prasain was arrested from his residence in Sanothimi, Bhaktapur, on November 17 for investigation related to public security.
