Habeas corpus petition quashed

The Supreme Court today quashed a habeas corpus writ petition, which sought the Supreme

Court order to the government to release jailed polit bureau member of the Communist Party of Nepal- Maoists, Matrika Prasad Yadav.

A division bench comprising Chief Justice Dilip Kumar Paudel and ad-hoc judge Rajendra Prasad Koirala quashed the petition citing the reason that Yadav is in detention as per the judicial order.

“Since Yadav is under detention with the order of the Patan Appellate Court, there is no need to issue habeas corpus order,” the bench said.

The Patan Appellate Court, about a month ago, had given a permission to the government to detain Yadav and another Maoists leader Suresh Ale Magar in a murder case.
