The Supreme Court has ordered the Parliament Secretariat to procure the report submitted by the Impeachment Recommendation Committee that investigated impeachment allegations against former chief justice Cholendra Shumsher JB Rana.

A five-member constitu-tional bench led by Acting Chief Justice Hari Krishna Karki ordered the Parliament Secretariat to submit the probe committee report.

Earlier, the apex court had stayed the execution of the letter written by Secretary General of Parliament Secretariat Bharatraj Gautam giving clean chit to Chief Justice Cholendra Shumsher JB Rana, who faced impeachment motion in the House of Representatives.

Rana, who was suspended after the impeachment motion was registered in the Parliament, retired from service on December 13.

The SC had earlier stated in the interim order that Gautam did not cite any legal basis for lifting Rana's suspension.

Nine lawyers, including Shakya, Vice-president of SCBA Mukunda Prasad Paudel, and Advocate Bikash Bhattarai had filed a writ petition at the Supreme Court on December 7 demanding that the court stay the implementation of Gautam's decision.

Opinions are divided as to whether or not the Impeachment Recommendation Committee report should be owned by the new HoR formed after November 20 parliamentary elections.
