Apex court acquits four of attempt to murder charges

The Supreme Court today upheld the Patan Appellate Court’s verdict to acquit Ganesh Lama, Umesh Lama, Rewat  Karki and Ramesh Sunuwar of attempt to murder charges.

According to Spokesperson for the Office of Attorney General Sanjiv Raj Regmi, Kathmandu District Court had acquitted Gurung of attempt to murder charge but held him guilty of causing hurt and imposed a jail sentence of two years on him for the same.

Kathmandu District Court had also acquitted the other three Umesh Lama, Rewat Karki and Ramesh Sunuwar in the case which was also upheld by the Patan Appellate Court.

Regmi said the Office of Attorney General had filed a memorandum of appeal at the Supreme Court  demanding that the four accused, who were acquitted of attempt to murder charges by the lower courts, must  be held guilty of attempt to murder.

Today, the SC upheld the lower court’s acquittal verdict in the case. Regmi said if Rajib Gurung alias Dipak Manange did not file a memorandum of appeals then the Patan Appellate Court’s decision to impose five-year-jail term would be the final verdict and he will have to go to jail. It is not known whether he has lapsed his time to file a memorandum of appeal. He could file a memorandum of appeal within 130 days from the day he receives a copy of the court’s verdict. It is not known whether he has received a copy of the verdict. Rajib Gurung could not be contacted for comments.

A criminal case was first filed against Ganesh Lama, Umesh Lama, Rewat Karki and Ramesh Sunuwar and Rajib Gurung alias  Dipak Manange in 2007 at the Kathmandu District Court accusing them of attempt to

murder.

A division bench of justices Deepak Raj Joshee and Purushottam Bhandari upheld the Patan Appellate Court’s acquittal verdict.
