KATHMANDU, DECEMBER 27

A Nepali Congress lawmaker, Tek Bahadur Gurung, who was elected from Manang constituency under the firstpast-the-post election system, will not be able to take part in proceedings of the Lower House as a corruption case filed against him and 13 other defendants remains sub judice at the Special Court that adjudicates corruption and abuse of authority cases.

The Parliament Secretariat today issued a notice saying that Gurung remains suspended since December 23 when the Commission for the Investigation of Abuse of Authority wrote to the Parliament Secretariat notifying it that a corruption case against Gurung was sub judice at the Special Court.

In accordance with Section 33 of the Prevention of Corruption Act, if a corruption case is filed against a public post holder, that person will ipso facto remain suspended till the adjudication of the case.

The Parliament Secretariat stated in its notice that the Commission for the Investigation of Abuse of Authority wrote to it on December 23 telling it to ensure that Gurung remains suspended till the final adjudication of the case. The CIAA had filed a corruption case against Gurung on 4 February 2019.

The CIAA had filed a corruption case against 14 people, including Gurung, for renting Fun Park Land at Bhrikuti Mandap at a much lower price compared to the market rate.

The CIAA has sought to recoup Rs 315,217,675 from defendants -- former minister Badri Neupane, former vicechair of SWC Pramod Mehata, former treasurer of SWC Kunja Bihari Prasad Chaudhary, Mohan Raj Sharma, Madan Kumar Lal Karna, Hari Neupane, Tek Bahadur Gurung (Bhrikuti Mandap Fun Park operator), and Rabindra Gurung (main operator of Bhrikuti Mandap Fun Park).
